Formbug is owned by BluSilva. By using this website, you agree to be bound by BluSilva's terms and conditions set on this page.

1. General
The terms of service set out on this page may be changed without notice. Your continued use of this site after any such changes constitutes your acceptance of the new terms of service.
2. Intellectual Property
All the content, trademarks and data on this web site, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of, or are licensed to BluSilva and as such are protected from infringement by local and international legislation and treaties.
3. Website Links
BluSilva accepts no responsibility for the quality, content, nature or reliability of sites accessible by hyperlink to and from this site. Any linked sites are not under the control of BluSilva and BluSilva is not responsible for the content of any linked site or any link contained in a linked site, or any review, changes or updates to such sites. The inclusion of any link does not imply affiliation or endorsement by BluSilva of the site or any information contained therein. When leaving the Formbug site, you should be aware that Formbug's terms of service and privacy policy are no longer applicable, therefore you should review the destination site's applicable policies.
4. Private Information
Formbug lets you create and send invoices and quotes to your customers. The invoices and quotes you create can only be accessed by you. If you choose to email the generated documents, you confirm that you are sure it is for the intended recipient. BluSilva does not take any responsiblity for errors.
5. Public Information
When you generate emails and quotes on Formbug, you may email them to your customers. The email designer allows you to customise your email design including uploading images. Because these images are meant to be opened in emails, these images must be made publicly available. When you upload images you confirm that you are aware that these images can be accessed from any computing devices. These devices may include mobile phones, tablets, personal computers, laptops, servers, search engines like Google and Bing and any computer that has access to the Internet.
6. Acceptable Use
6.1. While we allow unlimited usage for Formbug premium users, we reserve the right to suspend suspicious and extreme usage, particular where emails are concerned.
6.2. In using this site, and any of the services it offers, you agree:
6.2.1. Not to disrupt or interfere with the security of, or otherwise abuse the site, or any services, system resources, accounts, servers or networks connected to or accessible through the site or affiliated or linked web sites;
6.2.2. Not to violate, or attempt to violate the security of Formbug. Violations of system or network security may result in civil or criminal liability. BluSilva will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
6.2.3. Not to disrupt or interfere with any other user’s enjoyment of the site or affiliated or linked websites
6.2.4. Not to upload, post or otherwise transmit through or on this site any viruses or other harmful, disruptive or destructive files;
6.2.5. Not to transmit through or on this site, spam, chain letters, junk mail or any other type of unsolicited mass email to people or entities who have not agreed to be part of such mailings;
6.2.6. In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted under your account (if applicable), and that you will comply with all applicable local, national and international laws and regulations in this regard.
7. Indemnification
You shall remain solely liable for the content of any messages or other information you upload or transmit to Formbug. You agree to indemnify and hold harmless BluSilva from any claim, action, demand, loss or damages (including attorneys’ fees) made or incurred by any third party arising out of or relating to your conduct, your violation of this end user agreement, or your violation of any rights of a third party.
8. Submissions
You agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, provided by you in the form of email or submissions to Formbug, or postings on this site, are non-confidential and shall become the sole property of BluSilva. BluSilva shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you. The submission of any materials to Formbug irrevocably waives any and all “moral rights” in such materials, including the rights of paternity and integrity.
9. Email Disclaimer
9.1 The information in all email messages (document and attachments) sent by an employee / electronic agent / a legal member of BluSilva is confidential and may be legally privileged. The information transmitted is intended only for the person(s) or entity to which it is addressed. If you are not the intended recipient(s), please notify the sender immediately and then delete this email (document and attachments). Do not disclose the contents of this email (document and attachments) to any other person, nor make any copies thereof.
9.2 Internet communications cannot be guaranteed to be secure or error-free. Neither BluSilva nor the sender accepts liability for any errors or omissions in the contents of messages which arise as a result of email transmission. If verification is required, please request a hard copy version. Also take note that email can possibly contain viruses and that the recipient is responsible for checking and deleting viruses. In no event will BluSilva or the sender be liable to anyone for any indirect, special, consequential or direct damages arising from the transmission of email messages, the opening of email messages and their attachments, or any use thereof whatsoever.
9.3 No employee is authorised to conclude a binding agreement on behalf of BluSilva or Formbug by email without the express written confirmation of a director of BluSilva. Nothing contained in said email shall be construed as a legally binding agreement or an offer to contract.
10. Support
Premium users have access to Formbug's support ticket system while free users may refer to the FAQ's or email us at support@formbug.com. The support ticket system is built exclusively to allow users to report bugs and for billing queries. Formbug reserves the right to close any support tickets that do not fit into these categories or have not received a response from you in seven (7) days.
11. Payment
When you decide to upgrade from free to premium, you will directed to Payfast's secure payment portal. No payment information is processed on formbug.com. By using this service, you agree you have also read Payfast's end-user agreement and privacy policy. By signing up to a premium subscription, you understand you will be billed on a monthly basis, starting from the day you sign up. You may cancel your subscription at any time.
12. Premium Cancellation and Expiration
You may cancel your premium subscription at any time. You can do this by opening a support ticket from the support page on your dashboard. Please allow up to 48 hours for your subscription to be cancelled. Should you wish to cancel immediately, please create an account on Payfast using the same email address you used on Formbug when you subscribed.
Should you decided to cancel your premium subscription, you will no longer have access to any of the premium features. All your premium settings will remain intact unless your account is deleted.
13. Refunds
Formbug and the software used to run the site provides neither a guarantee nor a warranty and as such, Formbug does not take any liability for any errors or glitches. Users are encouraged to report any issues via the support ticket system. When you create an account on Formbug, you use the website and software at your own risk. No refunds will be granted for any errors on the user's part. Refunds may only be granted for incorrect billing after a thorough investigation has been conducted by Formbug.
14. Account Deletion
You may request to delete your account at any time by sending a support request to support@formbug.com. ALL of your existing information will be DELETED PERMANENTLY.
